1. Acceptance of Terms & Definitions
By registering or using Elinknest ("Service"), you agree to these Terms & Conditions and our Privacy Policy, compliant with Zimbabwe’s Cyber and Data Protection Act (CDPA). Key definitions:
Copyright Holder: Elinknest (Pvt) Limited (Entity No: 46432A1062025), owner of the Service.
Agreement: These Terms & Conditions.
Student/Client: Any capable individual who accepts this Agreement.
Student Account: Your personal section accessible after registration.
Content: Text, graphics, audiovisual, or other materials accessible via the Service.
If you do not agree, do not use our services.
2. User Eligibility
You must be 18+ or have verified parental/guardian consent.
You must provide accurate, complete, and lawful information during registration (including name,age, email, region, gender, National ID, and phone number as required).
3. Roles and Responsibilities & Service Usage
Subject of Agreement:
3.1 Elinknest grants Students a free, non-exclusive license to use the Service.
3.2 Elinknest is not a party to agreements between Tutors and Students.
Search/view Tutor profiles and Content.
Interact with Tutors to obtain services.
Leave respectful reviews/ratings.
Usage Rights: Territory is worldwide. Service access is granted upon:
(a) Viewing Content; or
(b) Student Account registration.
Registration & Student Account:
3.3 Full functionality requires registration.
3.4 You must keep registration data current and lawful under Zimbabwean law.
3.5 Elinknest may block accounts with false data or refuse registration for Agreement non-compliance.
3.6 All actions via your Student Account are deemed authorized by you.
3.7 Notify Elinknest immediately of unauthorized access (info@elinknest.com).
4. Data Protection & Privacy
Personal data is processed per CDPA [Chapter 12:07].
Registration constitutes consent for data use in matching, verification, and communication.

5. Account Security
You are responsible for securing your account credentials.
6. Payments and Fees
Service access is free.
7. Prohibited Activities
You must NOT:
Provide false information or violate Zimbabwean law.
Use the Service for spam, harassment, or harmful purposes (e.g., fake Tutor requests).
Attempt to access others' data or disrupt the Service.
Copy, decompile, reverse-engineer, or modify the Service.
Collect Service data via automated means or bypass technical restrictions.
8. Intellectual Property & Disclaimers
8.1 Elinknest owns all Service rights (software, design, interface).
8.2 Elinknest may modify the Service, set usage limits, collect usage data, and manage reviews at its discretion.
8.3 The Service is provided "AS IS." Elinknest disclaims warranties for:
Fitness for your purpose; guaranteed profits; uninterrupted/error-free operation; or legality outside Zimbabwe.
8.4 Preventive maintenance may cause temporary Service suspension without notice. No compensation is due for such suspensions.
9. Suspension and Termination
We may suspend/terminate accounts for:
Violating these Terms.
Providing fraudulent information.
Breaching CDPA or Zimbabwean law.
10. Dispute Resolution
Resolve disputes first via

Unresolved disputes fall under Zimbabwean law in civil/arbitration courts.
11. Updates to Terms
Posted updates in the Service are binding. Continued use implies acceptance.

1. Introduction
This Privacy Policy outlines how Elinknest (Pvt) Ltd (“Elinknest”, “we”, “us”) collects, uses, stores, and protects personal data in compliance with the Cyber and Data Protection Act [Chapter 12:07] (“CDPA”) of Zimbabwe.
By using our platform (mobile/web), users (“you”, “Students”) agree to the terms of this policy.
2. Legal Basis for Processing
We process personal data under the following legal grounds as per Section 27 of the CDPA:
• Consent – freely given, specific, and informed.
• Contractual Obligation – to fulfil service agreements.
• Legal Obligation – to comply with regulatory bodies (e.g., ZIMRA, POTRAZ).
• Legitimate Interest – where processing is necessary for the improvement of services.
3. Categories of Data Collected
• Full name, age, gender, grade level, contact information of guardian.
• Learning preferences, availability, location, learning objectives.
• Consent verification for underage students (via guardian/parent).
4. Purpose of Data Processing
• Matching tutors to students.
• Verification and safety screening.
• Providing academic recommendations.
• Processing tutor payments and student bookings.
• Monitoring app usage and performance.
• Legal compliance (e.g., safeguarding of minors).
5. Data Retention
• Personal data is stored only for as long as necessary for its processing purpose or as required by law.
• Logs and backups are retained for up to 12 months.
• guardian consent are retained for 7 years for audit and legal purposes.
6. Data Subject Rights
In accordance with CDPA Section 20, users have the right to:
• Access their personal data.
• Rectify incorrect or outdated information.
• Request erasure (“right to be forgotten”) under lawful conditions.
• Object to processing (especially marketing or profiling).
• Withdraw consent at any time.
• Data portability in a machine-readable format.

7. Children’s Data
For learners under 18 years of age, we:
• Require parent/guardian consent.
• Only process data necessary for educational matching.
• Do not market or profile children.
8. Data Transfers
Data may be processed by Elinknest-authorized third-party services (e.g., AWS, email services). Where data is stored outside Zimbabwe, we ensure:
• Contractual safeguards, and
• Compliance with CDPA Part V on cross-border data transfer.
9. Data Security
We implement the following technical and organizational security measures:
• Encryption of personal data in transit and at rest.
• Secure cloud storage and database firewalls.
• Two-Factor Authentication (2FA) for admin portals.
• Access control for staff handling personal data.
• Regular audits, penetration testing, and staff training.
10. Breach Notification
If a breach affecting your personal data occurs:
• We will notify POTRAZ within 24 hours.
• We will notify you without undue delay, outlining nature of breach and steps taken.

11. Use of Cookies & Analytics
We use cookies and analytics tools (e.g., AppMetrica) to improve service delivery. You can disable cookies in your browser settings, but some functionality may be affected.
12. Data Protection Officer
We have appointed a POTRAZ-certified Data Protection Officer (DPO) to oversee all privacy and compliance operations.
